General terms and conditions of contract — web design and development
At Siente La Red we apply these general terms and conditions of contract to our standard web design, online store and monthly maintenance services in Alicante and throughout Spain. If your project has a specific quotation, contract or SLA, that document prevails. Here you will find deadlines, payments, revisions and an indicative scope of our catalogue of WordPress development terms and web maintenance contracting.
Important notice — Scope and exclusion of custom projects
These Terms are general conditions of sale. They govern the contracting of standard services and fixed catalogue prices (e.g. published web packages, maintenance on 60/80/100 € plans, Online Store PRO, one-off quotations that expressly refer to these GTC).
They do not apply, under any circumstances, to custom projects, bespoke integrations, rescues, complex deployments, framework agreements, Service Level Agreements (SLAs), contracts with annexes, specific work orders or any engagement whose scope, price, deadlines, revisions or deliverables are governed by a particular document signed or accepted in writing between Siente La Red and the client.
Examples of engagements excluded from these GTC (non-exhaustive list): web developments + PMS/booking engine, multi-phase projects with investors, campaigns and full-service marketing under a monthly SLA, bespoke B2B e-commerce, migrations and rescues with their own conditions.
Each client and each project is assessed individually. Amounts, deadlines and scopes shown on the website are indicative unless set out in the quotation or contract accepted by the client.
Contractual primacy. If there is any conflict between these GTC and an accepted quotation, contract, SLA, annex or particular conditions, the specific document for the particular engagement shall always prevail.

1. Acceptance of the Terms
By contracting standard services from Siente La Red to which these GTC apply — via the website, email, telephone or any other means — the client agrees to be bound by these Terms and by the Privacy Policy.
Acceptance of a quotation issued by Siente La Red that refers to these GTC implies that they have been read and accepted, without prejudice to any particular conditions set out in that quotation, which shall prevail in the event of conflict.
Acceptance by payment: for standard services subject to these GTC, payment of the invoice or of the agreed deposit constitutes acceptance of these general terms and conditions, without prejudice to any particular document where one exists.
If the client has a specific contract or SLA, that document shall govern the relationship and these GTC shall not apply, unless the particular contract expressly refers to them for a specific aspect not otherwise regulated.
If you do not agree with these Terms, do not use our standard services.

3. Definitions
- Siente La Red / the Company: Carlos Sánchez Barbado, provider of the services.
- Client: natural or legal person who contracts standard services subject to these GTC.
- Standard services: catalogue or standard quotation deliverables to which these GTC expressly apply.
- Specific document: contract, SLA, accepted quotation, annex or work order governing a particular engagement under particular conditions.
4. Services to which these GTC apply
Siente La Red offers, among others, the following standard services (indicative catalogue; the binding detail shall be that of the accepted quotation):
4.1. Web design and development (indicative fixed rates)
- Landing Page / One Page (from 699 €)
- WP SMEs (from 1,299 €)
- WP Plus (from 2,399 €)
4.2. Online Store PRO (standard service)
Development and implementation of an online store with WordPress, Avada theme and WooCommerce; responsive design; up to 10 agreed content pages; loading of up to 25 products; agreed payment methods (POS terminal, PayPal, bank transfer, Bizum or others); initial on-page SEO; SSL; introductory training; 15 days of post-launch support.
Indicative price: 1,799 € (+ VAT, unless otherwise stated). Payment: 50% at the start, 50% before launch, unless otherwise set out in the quotation.
Additional services not included will be quoted separately.
4.3. Website maintenance (standard monthly plans)
- Standard Plan (60 €/month): basic content updates, monthly technical maintenance, basic support, basic speed optimisation.
- Advanced Plan (80 €/month): includes Standard + quarterly SEO review, monthly reports, content optimisation, social media integration.
- Premium Plan (100 €/month): includes Advanced + monthly blog, Google Business Profile, competitor analysis, digital marketing advice.
4.4. Other standard services (subject to quotation)
- Advanced SEO, consultancy, domains, hosting, professional email.
- SEM campaign management (specific conditions in §6).
- Migrations, blogs and responsive design when contracted as a quoted standard service.
The detailed description, final price, deadlines and exclusions of each engagement shall be set out in the accepted quotation. Indicative links: web design pricing · web maintenance pricing.
5. Contracting process and quotations
- Request: the client describes their requirements.
- Quotation: Siente La Red sends a proposal with services, prices and estimated deadlines.
- Validity: 30 days, unless otherwise stated.
- Acceptance: implies these GTC only if the engagement is standard and no specific document excludes or amends them.
- Formalisation: payment of the agreed deposit formalises the engagement. Changes requested by the client may alter the quotation and deadlines.
6. Payment for services
- Prices: exclusive of VAT unless otherwise stated.
- Web development (fixed rate): 40% at the start; 60% on delivery/migration, unless otherwise set out in the quotation.
- Monthly maintenance: first month in advance; subsequent months according to the agreed schedule.
- Payment method: bank transfer (proof of payment sent by the client).
- Advertising spend (SEM): the client provides a payment method directly to Google, Meta or other platforms.
- Standard SEM management: when contracted as a catalogue service: 599 € initial campaign design + minimum 6-month commitment, unless different conditions are set out in the quotation. Siente La Red may refuse client changes that would harm campaign performance.
- Late payment and non-payment: unpaid invoices shall accrue, from their due date, the legally applicable interest. After a reasonable grace period (15 calendar days from the due date), Siente La Red may suspend services, maintenance, support or access linked to the non-payment until the situation is regularised.
7. Delivery deadlines and content
- Siente La Red shall respect the deadlines agreed in the quotation.
- The client shall deliver content (text, images, videos) within the agreed deadlines.
- Client delay of more than 7 days in delivering initial content: Siente La Red may close the project and apply the cancellation policy in §12 (with no obligation to refund the deposit if closure is due to the client's breach).
- Ongoing delays during development: a surcharge of 5% of the final price per week of delay attributable to the client, without prejudice to other rights.
8. Technical requirements and installation
- The client shall provide the necessary access credentials (FTP, hosting, etc.).
- Development on Siente La Red's staging server, unless otherwise agreed.
- Migration included for common Linux/MySQL hostings (Piensa Solutions, Cdmon, IONOS/1&1, Arsys, DigitalOcean, Wetopi, etc.). Other hostings: assessment and separate quotation.
- Hosting maintenance: the client's responsibility unless maintenance is contracted with Siente La Red.
- Non-Linux hostings are not supported unless expressly agreed.
9. Intellectual property, content, confidentiality and data protection
- The client warrants that they are the owner or licensee of the content they supply.
- The client shall hold Siente La Red harmless against claims arising from content supplied by the client.
- Upon full payment for the standard service, the client obtains exploitation rights over what has been developed for their use; Siente La Red retains rights over reusable tools, libraries and generic know-how.
- Legal texts (legal notice, privacy): the client must supply the final versions or commission their drafting separately.
- Confidentiality: Siente La Red shall treat with due care any non-public client information accessed through the engagement, and shall not disclose it to third parties except where legally required or with consent, save as necessary to subcontract technical services (hosting, domain, APIs) or to showcase the project in the portfolio in accordance with §18.
10. Change revisions
- Two (2) rounds of minor (non-substantial) revisions included in standard design/development services.
- Substantial changes: separate quotation.
- SEO / monthly content under standard plans: client review without entitlement to substantial changes that alter the agreed strategy.
11. Communication, feedback and meetings
- Primary channel: email.
- Siente La Red does not guarantee permanent availability of immediate feedback.
- In-person meetings not included unless agreed; additional meetings quoted separately.
- Client delay in providing information or reviews: application of §7.
12. Cancellation
- The client may cancel in writing.
- Siente La Red shall invoice for work performed up to the date of notification.
- For standard services with a deposit, if cancellation is due to serious client breach (content, deadlines, lack of cooperation), the deposit may be applied to work already performed or expenses incurred, with no refund.
- For monthly maintenance, cancellation takes effect at the end of the current billed period, unless otherwise agreed.
13. Website operation
- Compatibility with majority browsers and devices; operation with exotic configurations or user extensions is not guaranteed.
- Adaptations to new browser/system versions after delivery: separate quotation unless covered by contracted maintenance.
14. Management of websites and online stores
- Self-manageable delivery; the client must have basic WordPress/WooCommerce knowledge or contract maintenance.
- Extended tutorials and screenshots: separate quotation.
- Client changes that disrupt the design (fonts, colours, layout): separate quotation.
- Advanced analytics, invoicing, ERP and similar plugins: not included unless quoted.
15. Post-delivery maintenance
- The website is delivered in correct working order; the client must verify this on delivery.
- Subsequent requirements: separate quotation, unless a maintenance plan is contracted.
- Code manipulation by the client or third parties: Siente La Red may quote separately for remediation.
16. Domain and hosting
- Domains registered in the client's name.
- With standard SLR maintenance: hosting may be included depending on the plan.
- Cancellation of maintenance: migration at the client's expense or quoted separately with SLR. The client retains the domain and content; they must have new hosting in place before the effective cancellation date.
17. Results, marketing, subcontracting and limitation of liability
- Siente La Red does not guarantee specific commercial results (sales, bookings, occupancy, leads, SEO rankings, ROAS, etc.).
- Success also depends on the product, pricing, operations, seasonality and the client's own actions.
- Except in cases of wilful misconduct or gross negligence, Siente La Red's maximum liability to the client for a standard engagement shall be limited to the total amount paid or due for that particular engagement to which these GTC relate.
- It shall not be liable for hosting outages, third-party APIs, advertising platforms, OTAs, PMS or services outside its control once the work has been delivered, unless expressly contracted maintenance covers them.
- Subcontracting and third parties: Siente La Red may use external providers (hosting, domain registration, Google, Meta, plugins, payment gateways). Each party shall be liable within its own sphere of control; the client shall contract directly those services that require an account or billing in their name (e.g. SEM spend).
- Force majeure: neither party shall be liable for breaches due to force majeure (disasters, conflicts, widespread network failures, acts of public authorities, etc.) for as long as they persist, and must notify the other party without delay.
18. Credits and portfolio
- Reference to Siente La Red in the project footer, unless otherwise agreed in writing.
- Right to include the project in the portfolio and commercial materials, unless confidentiality has been agreed.
19. Amendments to these GTC
Siente La Red may amend these General Terms and Conditions. Versions published at this URL shall apply to new standard contracts from the date of publication.
They shall not apply retrospectively to contracts, SLAs, accepted quotations or particular agreements already in force, unless expressly agreed in writing.
20. Governing law, consumers and jurisdiction
These GTC are governed by Spanish law. For engagements to which they apply, the parties submit to the Courts and Tribunals of Alicante, unless a mandatory rule provides otherwise for consumers.
B2B relationship and consumers: where the client acts as a consumer and the law so requires, they may exercise the 14-day right of withdrawal only if the service has not commenced with their prior express consent. For services already commenced at the client's request, the applicable consumer legislation shall apply.
In relationships with consumers, information is provided on the possibility of using the European Union ODR platform.

The first month is charged in advance and subsequent months according to the agreed schedule, normally by bank transfer. An unpaid invoice may incur statutory interest and suspension of the service after 15 days from the due date.
You may cancel in writing; it usually takes effect at the end of the billed period. You must migrate to another host before cancellation if hosting was included in your plan. Siente La Red can quote for the migration separately.
